1. Who we are

ClearBGV, with its registered office at Pegasus Tower, Block-A, Sector 68, Noida, Uttar Pradesh - 201309 ("ClearBGV", "we", "us").

When we run background verification for an employer, that employer is the Data Fiduciary and ClearBGV acts as a Data Processor on their documented instructions. When you use this website or contact us directly, we are the Data Fiduciary for that interaction.

2. Personal data we collect

The categories we handle depend on the checks the employer has requested and the consent you have given.

3. Why we process it

For verification activity our lawful basis is your consent, obtained before any check begins. Where we must retain records to meet a legal obligation, we rely on that obligation.

• To perform the background verification the employer has engaged us for, with your consent
• To confirm your identity and prevent impersonation or fraud
• To respond to your queries, disputes and rights requests
• To meet our legal, regulatory and contractual obligations
• To secure, maintain and improve our systems and service quality

4. Who we share it with

We do not sell personal data. We do not use candidate data for advertising or profiling of any kind.

• The employer or their authorised representative who requested the verification
• Verification sources — previous employers, educational institutions, registrars and government bodies — strictly to the extent needed to confirm a fact
• Vetted international verification partners, where a check falls outside India
• Service providers for hosting, communications and security, under written confidentiality terms
• Courts, regulators or law enforcement where we are legally compelled

5. Cross-border transfers

Where a check requires verification outside India, or where a service provider processes data outside India, we transfer only the minimum data necessary and only to jurisdictions and partners bound by contractual safeguards at least equivalent to our own obligations.

6. How long we keep it

We retain verification records for 5 years from case completion, or for the period specified by the employer in our agreement with them, whichever is shorter, unless a longer period is required by law. After that, records are securely deleted or irreversibly anonymised.

7. Your rights

Send requests to bgv_request@clearbgv.com. We acknowledge within 72 hours and respond within 30 days. We may ask you to verify your identity before acting.

• Access — ask what personal data we hold about you and obtain a summary
• Correction — have inaccurate or incomplete data corrected
• Erasure — request deletion where we no longer need the data and no law requires us to keep it
• Withdraw consent — at any time, with effect going forward
• Nominate — appoint someone to exercise your rights if you are unable to
• Grievance — escalate through our grievance redressal process

8. Security

We apply encryption in transit and at rest, role-based access control, audit logging, staff vetting and mandatory data-protection training. No system is perfectly secure, but we maintain a documented incident response plan and will notify you and the Data Protection Board of India of a reportable breach without undue delay.

9. Cookies

This site uses only the cookies necessary to operate it and to understand aggregate usage. We do not use advertising or cross-site tracking cookies.

10. Children

Our services are not directed at children. We do not knowingly process the personal data of anyone under 18 without verifiable parental consent as required by the DPDP Act.

11. Changes to this policy

We may update this policy. The effective date at the top of this page always reflects the current version, and material changes will be communicated to affected clients and candidates.
